Terms of Service

HyperReal Photo AI provides an artificial intelligence-powered photo generation platform. Our Service allows you to:

• Upload personal photographs ("Training Images") to train a custom AI model based on your likeness
• Generate new, AI-created photographs ("Generated Images") using your trained model
• Download, share, and use Generated Images for personal or commercial purposes
• Access a variety of styles, prompts, and photo packs curated by our team

The Service relies on third-party AI infrastructure for model training and image generation. Results may vary based on the quality and quantity of Training Images provided.

By using the Service, you represent and warrant that:

• You are at least 18 years of age or the age of majority in your jurisdiction, whichever is greater
• You will not upload, generate, or distribute any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• You have the legal right to upload any Training Images you provide, and such images are of yourself or you have explicit consent from the depicted individual
• You will not use the Service to create content that infringes on the intellectual property rights of any third party
• You will keep your account credentials secure and are responsible for all activity under your account
• You will comply with all applicable local, state, national, and international laws and regulations

Ownership of Generated Images. You retain full ownership of all Generated Images created through the Service using your trained model. You are free to use, modify, distribute, and commercialize these images without restriction, subject to applicable law and these Terms.

Training Image License. By uploading Training Images, you grant HyperReal a limited, non-exclusive, non-transferable license to process and use those images solely for the purpose of training your custom AI model. We retain the right to process Training Images for model creation as part of delivering the Service. We do not use your Training Images to train general-purpose models or share them with other users.

No Guarantee of Results. AI-generated content may not always meet your expectations. We do not guarantee specific outcomes, likeness accuracy, or fitness for any particular purpose.

Subscription Billing. Subscription plans are billed on a recurring monthly or annual basis, depending on the plan selected. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time from your account dashboard.

Credit System. Certain actions within the Service (such as model training and photo generation) consume credits. Subscription plans include a monthly credit allocation that resets each billing cycle. Subscription credits do not roll over to the next period.

One-Time Packs. We offer one-time headshot packs and credit top-up packs that do not require a subscription. Credits purchased through top-up packs do not expire.

Payment Processing. All payments are processed securely through Stripe. We do not store your full credit card information on our servers.

We offer a 14-day money-back guarantee on all subscription plans. If you are not satisfied with the Service within 14 days of your initial purchase, contact our support team for a full refund.

One-time headshot packs are eligible for a refund if no photos have been generated yet. Credit top-ups are non-refundable once credits have been used. For complete details, please see our Refund Policy.

Training Images. Your Training Images are automatically deleted from our servers after 30 days by default. You may request earlier deletion at any time from your account settings.

Generated Images. Your Generated Images are stored on our servers until you delete them or until your account is deleted.

Account Data. Your account information and associated data are retained until you choose to delete your account. Upon account deletion, all personal data, models, and images are permanently removed within 30 days.

You agree not to use the Service for any of the following purposes:

• Deepfakes. Creating realistic images of real people without their explicit consent, particularly for deceptive, fraudulent, or malicious purposes
• Non-consensual content. Generating NSFW, intimate, or sexual content depicting any person without their explicit, verifiable consent
• Impersonation. Creating images intended to impersonate another person for fraud, identity theft, misinformation, or any deceptive purpose
• Illegal activity. Generating content that facilitates or promotes illegal activities, including but not limited to child exploitation, terrorism, or hate speech
• Harassment. Using generated images to bully, threaten, intimidate, or harass any individual
• Misinformation. Creating images intended to spread false information or deceive the public

Violation of this Acceptable Use policy may result in immediate account termination without refund and, where applicable, reporting to law enforcement authorities.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HYPERREAL PHOTO AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

By You. You may terminate your account at any time by deleting your account through the account settings in your dashboard. Upon termination, your access to the Service will cease immediately.

By Us. We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable. We may also terminate accounts that have been inactive for an extended period.

Effect of Termination. Upon termination, your right to use the Service will immediately cease. We will delete your data in accordance with our data retention practices described in Section 6. Any credits remaining in your account at the time of termination are forfeited and non-refundable, except as required by applicable law.
